Nach dem Urteil des Verfassungsgerichtshofes des Saarlandes vom 5. Juli 2019, wonach ein Bußgeldbescheid wegen einer Geschwindigkeitsüberschreitung nicht auf die Messung eines Blitzers gestützt werden darf, der die Rohmessdaten nicht speichert, haben die ersten Bundesländer die bei ihnen genutzten Blitzer abgeschaltet, darunter auch Berlin und Brandenburg.
Das Gericht hatte den schon seit jeher von der Verteidigung erhobenen Einwand, ohne Rohmessdaten sei eine sachgerechte Verteidigung unmöglich, ernst genommen und die Aufnahmen des betroffenen Gerätes Jenoptik TraffiStar S350 für unverwertbar erklärt. Indes ist dies nicht das einzige Gerät, das die Rohmessdaten nicht speichere. Das Land hatte sich damit verteidigt, die Nicht-Speicherung entspräche dem Grundsatz der Datensparsamkeit.
Berlin hat nun etwa die Blitzer in der Frankfurter Allee und in der Seestraße entfernt. Zu hoffen ist allerdings, dass Autofahrer nun nicht blindlings die Rechtsstaatlichkeit des Verfassungsgerichtshofs für Rasereien ausnutzen. Immerhin sei daran erinnert, dass die Polizei noch über mobile Geschwindkeitsmessgeräte verfügt, die den Anforderungen des Gerichts genügen.
